Should I make a Will?

Everyone needs a Will, to ensure your hard-earned assets are protected where ever possible and go to the people or causes which you care the most about.

Many people delay or have doubts about making a Will and around 180,000 people a year die intestate (without making a will).





Making a Will is not only for the elderly or unwell.

Ensuring you have a Will can avoid significant

problems for those you leave behind.






Here are some reasons why you should make a Will:-


1. Peace of mind and knowing that you are in control. You choose who will benefit from your

estate and what they are entitled to. You also decide who will administer your affairs after

your death.


2. Making a Will gives you the opportunity of saving inheritance tax liability. This is particularly

important if you have substantial assets.


3. By not making a Will the rules of intestacy will decide who benefits from your estate and not

you. The rules can produce results that you would not necessarily have chosen yourself.


4. Instructing a suitably qualified solicitor to draft your Will can reduce the likelihood of problems

or disputes arising after your death.


5. Having a Will in place can limit the time, stress and cost of administering your estate.


6. A Will can sometimes be challenged on the basis that it is unfair, however, the courts are

generally more reluctant to interfere in the provision made by a Will than that provided for

by the rules of intestacy.


7. You can appoint a Guardian in your Will to have parental responsibility for your children.

Properly appointed Guardians have all the necessary legal rights and responsibilities. In many

cases appointing a Guardian in your Will provides valuable piece of mind that your children

are going to be looked after by someone you have chosen and trust.


8. A Will allows you to express your preferences for burial or cremation and for donating organs

or your entire body for medical purposes.


9. A properly drafted trust in your will could enable someone to manage the inheritance you

leave to a disabled or vulnerable person and may ensure the intended beneficiary does not

lose his/her means tested benefits.
